McCloud Judgement (2015)

Background:

In 2015 most public service pension schemes were reformed. Transitional protections allowed those within 10 years of retirement to remain in their existing pension scheme when the reformed schemes were introduced. However, in 2018 the courts found this to be discriminatory against younger members of judicial and firefighters’ pension schemes.

As a result the Department of Finance published a public consultation in August 2020 on options to remove this discrimination. Having considered all responses, the Department of Finance has set out its final proposed approach.

Who is affected:

Scheme members who were serving on or before 31 March 2012 and still serving on or after 1 April 2015 will be in scope of these proposals. This includes members who are currently active, deferred or retired.

You do not need to put in a legal claim to be eligible for these changes.

The judicial and local government pension schemes will receive different changes as a result of the unique arrangements in those schemes.

How are members affected:

To address the discrimination, eligible members will remain in, or be returned to, their old (legacy) schemes for service between 2015 and 2022. When benefits become payable members will receive a choice of whether they would rather receive the benefits of their reformed pension scheme for that period.

The choice will be offered as soon as practicable after legislative changes are implemented. This means that for both past and upcoming retirements, members who have transitioned to the CARE scheme will continue to receive benefits on that basis and any shortfall in pension will be backdated to your date of retirement as soon as practicable.

HM Treasury (HMT) current position is now that immediate detriment cases, including those yet to retire, cannot be processed before legislation is in place without considerable risk, uncertainty and administrative burdens for individuals, schemes and employers.  The HMT position highlights the risk of significant second or third adjustments to benefits for individuals if changes are processed now without full clarity on how the remedy should operate.

What’s next?:

For eligible members, the choice relating to their pension benefits will be offered as soon as practicable however, it is highly probable that this will be after legislative changes are implemented by October 2023. This means that for both past and upcoming retirements, members who have transitioned to the CARE scheme will continue to receive benefits on that basis and if the member chooses legacy benefits for the remedy period and there is a  shortfall in pension, this will be backdated to the date of retirement as soon as practicable. Eligible members do not have to do anything at this stage. Eligible members will be contacted by the pension scheme administrator in due course. These changes will take some time to be made as they require new legislation. The choice will be offered to you as soon as practicable once your benefits become payable. Any change to benefits will be backdated.

Governement’s response to consultation on public sector pensions remedy for Firefighters’ Pensions (MCCLOUD/SARGEANT): Phase Two, Retrospective Remedy

We are pleased to announce that the Home Office has published the government’s formal response to the consultation on the draft Firefighters’ Pensions (Remediable Service) Regulations 2023 and policy intent to implement the retrospective phase of the McCloud/Sargeant remedy.
